Introduction

This Privacy Policy describes how OpenMax Pte. Ltd. (hereinafter "OpenMax," "we," "us," or "the Company") collects, uses, shares, and protects personal information when you access or use openmax.com, OpenMax Workspace, and related products, features, and services (collectively, the "OpenMax Services").

OpenMax provides an AI collaboration Workspace and related AI Agent services. Through Workspace, users can organize and manage members, AI Agents, knowledge bases, files, memories, tasks, workflows, channels, permission settings, and other related resources, and can use AI Agents for information processing, content generation, tool invocation, task execution, and related collaboration.

By using this platform, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with this Policy, please stop using this platform.


1. Information We Collect

1.1 Account and Profile Information

When you register for, log in to, or use the OpenMax Services, we may collect information relating to your account and identity verification, including:

  • Name, email address, and other account profile information
  • Login and authentication information, including information you provide to us through single sign-on (SSO) or other authentication methods
  • Your subscription plan, account status, and information related to account management
  • Nationality, region of residence, and similar information (where required by applicable law)

1.2 Payment and Billing Information

When you purchase or subscribe to the OpenMax Services, we may collect information relating to payment and billing, including:

  • Subscription plans, order information, subscription and payment status, payment history, invoices, and other billing and related transaction information
  • Transaction identifiers, payment method types, and other necessary information provided to us by relevant payment service providers in connection with transactions, billing management, and dispute handling

Payments may be processed by third-party payment service providers. Full payment credentials, such as complete payment card numbers, are generally collected and processed directly by the relevant payment service providers, and OpenMax does not store your full payment card number. The principal payment service providers we currently use include Stripe, Airwallex, and others. The specific available payment service providers and payment methods may vary depending on your region, the transaction scenario, and platform support, as displayed on the applicable payment page.

1.3 Workspace and AI Agent Configuration Data

When you create, configure, or use a Workspace and AI Agents, we may collect and store:

  • Configuration information relating to the Workspace and AI Agents, including instructions, prompts, and other configurations

1.4 Workspace Content and Memory Data

When you use the Workspace and AI Agents, we may process and store information necessary to provide continuous and context-relevant services, including:

  • Summary context of prior conversations
  • User preferences, working patterns, and project-related information accumulated over time
  • Messages, prompts, files, attachments, conversation records, and outputs submitted by you or end users, as well as tasks, actions, and execution records relating to AI Agents

You may view, manage, export, or clear the relevant memory data in accordance with the features provided by the platform from time to time and your permissions within the Workspace.

1.5 Usage and Technical Data

We may automatically collect:

  • IP address, browser type, operating system, and device identifiers
  • Feature usage patterns, session duration, and access timestamps
  • Error and performance logs for the Workspace, AI Agents, and related services

1.6 Information from Third-Party Integrations

When you connect or authorize third-party products or services through the Workspace (such as Gmail, CRM systems, databases, etc.), we may, within the scope of your authorization, access and process the data necessary to provide the relevant features or perform the tasks you have configured. We do not proactively access data in third-party integrations that you have not connected or authorized.

1.7 Activity and Promotional Information

When you participate in promotions, redemptions, referrals, or other marketing activities, we may collect activity participation and redemption records, promotion or referral sources, activity channels, and information relating to your interactions with the relevant activities, for the purposes of activity management, redemption verification, effectiveness analysis, and abuse prevention.

1.8 User Feedback Information

Where the platform provides such functionality, when you rate, like/dislike, or otherwise provide feedback on the outputs of AI Agents, we may collect that feedback and the associated conversation content, for the purposes of evaluating and improving service quality.

1.9 Cookies and Tracking Technologies

We and service providers acting on our behalf may use cookies, web beacons, pixels, and similar technologies (collectively, "Tracking Technologies") on our website and marketing pages to: maintain login sessions and save your preferences; measure website visits and marketing campaign effectiveness through analytics tools (such as Google Analytics); and support our marketing and promotional activities.

You can manage or reject cookies through your browser settings, and you can use opt-out or privacy control tools provided by relevant third parties to manage such tracking. Disabling certain Tracking Technologies may affect some functionality of the website.


2. How We Use and Process Your Information

We collect, use, disclose, or otherwise process your personal information for the following purposes:

  • Providing and operating the OpenMax Services: Creating and managing your account and Workspace, processing content submitted by you or other users, providing AI Agents, knowledge bases, memory, tasks, workflows, channels, integrations, and other related features, and providing you with the corresponding service results.
  • Providing AI Agent–related features: Processing relevant input and contextual information, and invoking applicable AI models, tools, or third-party services, in accordance with your configuration, instructions, and authorization, to support AI Agents in information processing, content generation, tool invocation, task execution, and related collaboration.
  • Account and billing management: Account management, subscription management, plan upgrades/downgrades, payments, invoice generation, and related transaction matters.
  • Service maintenance and improvement: Analyzing service usage, performance data, and user feedback to maintain and improve the functionality, performance, and reliability of the OpenMax Services; provided that matters involving AI model training or improvement are handled in accordance with §3.2 AI Training and Data Use.
  • Security and abuse prevention: Monitoring for unauthorized access, fraud, and platform abuse.
  • Customer support and service communications: Responding to your inquiries, requests, or feedback, and sending you necessary notices relating to your account, subscription, service operation, maintenance, security, or other service matters.
  • Marketing and promotion: Where required by applicable law, and after obtaining your consent, sending you product updates, newsletters, event information, and other marketing or promotional information. You may unsubscribe or withdraw your consent at any time through the methods provided in the relevant marketing communications.
  • Activity management and analysis: Managing the relevant activities and redemptions, verifying activity participation, analyzing activity and channel effectiveness, and preventing fraud or abuse.
  • Legal compliance and protection of rights: Fulfilling applicable tax, regulatory, and legal obligations.

3. AI Processing and Third-Party Model Providers

Transparency about how AI processes your data is a core commitment of ours. This Section describes the complete data flow in detail.

The AI data processing flow described in this Section applies where you use OpenMax's own AI Agents: the relevant data will, in accordance with your configuration and instructions, be transmitted via OpenMax's infrastructure to the LLM providers listed in §3.1 LLM Providers We Use for processing.

Where you independently connect, access, or use third-party AI Agents through the Workspace, the relevant model invocation and processing are carried out independently by that third party, are not transmitted or processed through OpenMax's infrastructure, and OpenMax has no visibility into or control over such processing. Such data processing is governed by the third party's own terms of service and privacy policy (please refer to §10 Third-Party Links and Integrations for more information). Content that you generate through such third-party AI Agents and transmit back to the Workspace (such as execution results and message records) will be processed and stored in accordance with the provisions of this Policy relating to Workspace Data.

3.1 LLM Providers We Use

In providing AI Agent–related features, OpenMax may, based on your instructions, Workspace configuration, and the requirements of specific tasks, transmit relevant input content, prompts, files, contextual information, and other data necessary to provide the relevant features to third-party large language model or other AI model providers for processing. The relevant model providers may be used to support inference, dialogue, content generation, information processing, task execution, and other AI functions.

The principal model providers we currently use include Anthropic, OpenAI, and others. The specific models and model providers used may be adjusted from time to time based on product features, technical solutions, service availability, and other reasonable business needs.

If such adjustments result in material changes to the processing of personal information described in this Policy, we will follow the procedures set out in §11 Changes to This Policy.

3.2 AI Training and Data Use

Unless you have separately given your express consent, we will not use your Workspace Data to train, fine-tune, or improve any AI model.

Specifically:

  • Your conversations, files, AI Agent memory, and task outputs will not be incorporated into any training dataset;
  • We only select LLM providers whose applicable terms of service, data processing agreements, or other contractual arrangements expressly provide that customer data transmitted through OpenMax will not be used to train or improve their general-purpose models;
  • Data sent to LLM providers' APIs is used solely to process your requests and provide the relevant AI features. The relevant providers may process or retain such data for a limited period to the extent necessary to provide services, ensure security, prevent abuse, troubleshoot, or fulfill legal and compliance obligations.

If we introduce any feature in the future that requires the use of user data for model training or improvement, we will explain the relevant processing in advance and obtain your express consent before using such data.

The foregoing commitments do not affect our ability to analyze feedback information (including associated conversation content) that you proactively provide, for the purposes of security and compliance assessment, identifying and handling content that violates this Policy or applicable usage policies, and evaluating and improving service quality. If we intend to use such feedback information to train, fine-tune, or improve AI models, we will explain the relevant processing in advance and obtain your express consent.

3.3 How Data Flows Through AI Agents

  1. You or other authorized Workspace members provide messages, instructions, files, or other content to an AI Agent through the Workspace or through the relevant channels you have configured within the Workspace.
  2. OpenMax processes the relevant input and loads the relevant memory, files, knowledge, and other contextual information related to the task.
  3. Where a third-party large language model needs to be used, the relevant content is transmitted to the applicable LLM provider over an encrypted connection.
  4. The LLM provider processes the request, generates a response, and returns the corresponding result; the relevant data may be processed or retained as necessary in accordance with §3.2 AI Training and Data Use .
  5. OpenMax provides the corresponding output to you or the relevant Workspace members through the Workspace or through the relevant channels you have configured within the Workspace.
  6. The relevant conversation, task, and execution records may be stored in accordance with the Workspace settings and the rules described in this Policy.

3.4 AI Agent Collaboration and Communication

OpenMax supports collaboration and communication among AI Agents through the Workspace. The relevant information may be transmitted and processed among the relevant AI Agents based on the Workspace's configuration, permissions, and task requirements.

  • The relevant communication and execution records may be stored in the Workspace and made available for viewing by Workspace members in accordance with the corresponding permissions;
  • AI Agents may, in accordance with your configuration and instructions and within the scope of your authorization, access connected integrations and perform related operations.

Workspace administrators should configure and manage the access permissions and authorization scope of AI Agents and related integrations in accordance with actual business needs and the principle of least privilege.

3.5 AI Agent Execution Transparency

When an AI Agent performs relevant tasks or operations in accordance with your configuration, instructions, and authorization, OpenMax may record:

  • The type of operation, timestamp, and execution status
  • The input provided and the output generated
  • The channels, tools, and integrations involved

The relevant records may be made available for access by Workspace administrators or other authorized Workspace members in accordance with the platform's functionality and the Workspace permissions.

3.6 Memory Management

AI Agents within the Workspace may use memory functionality to support continuous and context-relevant services. In accordance with the features provided by the platform from time to time and your permissions within the Workspace, you may view, manage, export, or clear the relevant memory data.

AI Agents' access to and use of the relevant memory data are subject to the Workspace configuration, task requirements, and corresponding permission controls.


4. How We Share Your Information

4.1 Service Providers

To operate and provide the OpenMax Services, we may, to the extent necessary to achieve the relevant service purposes, disclose personal information to third-party service providers or engage them to process the relevant personal information on our behalf. The principal service providers we currently use include:

The above lists the principal service providers we currently use and is not a complete or exhaustive list. The specific service providers may be adjusted from time to time based on product features, technical solutions, service availability, and other reasonable business needs. If such adjustments result in material changes to the processing of personal information described in this Policy, we will follow the procedures set out in §11 Changes to This Policy.

The relevant service providers may only process personal information to the extent necessary to provide their respective services to OpenMax, and shall comply with applicable contractual and data protection obligations.

4.2 Connected Integrations

When you connect or authorize third-party products or services through the Workspace, including communication channels, applications, tools, or other integrations, the relevant data may, in accordance with your configuration and authorization, be transmitted to or processed by the relevant third parties to the extent necessary to provide the relevant features. The relevant third parties will process the relevant information in accordance with their own privacy policies, terms of service, and other applicable rules.

4.3 Legal Requirements

We may disclose information as required by law, regulation, legal process, or governmental request, or to protect the rights, safety, or property of OpenMax, our users, or the public. Where permitted by law and reasonably practicable, we will notify you of such requests.

4.4 Business Transfers

In the event of a merger, acquisition, or sale of assets, your information may be transferred to the acquiring entity. We will provide you with notice by reasonable means, to the extent required by applicable law.

4.5 Our Data Use Commitments

  • We do not sell your personal data.
  • We will not use your conversations or content to train, fine-tune, or improve AI models without your separate express consent.
  • We will not share data with affiliates for undefined purposes.

4.6 Sharing with Marketing Partners

Where required by applicable law and with your consent, we may send you product updates, event information, and other marketing information. We may engage email, customer relationship management, advertising, or marketing analytics service providers to process necessary personal information on our behalf, and such service providers may only process the relevant personal information to the extent necessary to provide the relevant services to us and as permitted by applicable law.

You may withdraw your marketing consent at any time through the unsubscribe method provided in the marketing communications or by contacting privacy@openmax.com. After withdrawal, we will cease using or disclosing your personal information for the relevant marketing purposes, but this does not affect the lawfulness of processing carried out prior to the withdrawal.


5. Data Security

5.1 Workspace Isolation

OpenMax takes reasonable technical and organizational measures to isolate the data of different Workspaces and to implement access controls, in order to prevent unauthorized cross-Workspace data access.

5.2 Data Retention Period

We retain personal information only for as long as necessary to fulfill the purposes described in this Policy, or for the period required by applicable law.

  • Account information: Generally retained for the duration of the account;
  • Workspace Data: Including conversations, files, memory, tasks, and execution logs, retained in accordance with the Workspace settings, applicable service configuration, or the default period published on the platform from time to time;
  • Billing and transaction records: Retained in accordance with applicable tax and accounting requirements;
  • Security and technical logs: Retained for the period necessary to safeguard service security, prevent and investigate security incidents, handle disputes, and fulfill other reasonable business purposes.

Following account cancellation, Workspace deletion, or your submission of a valid data deletion request, we will delete or de-identify the relevant personal information in accordance with applicable law and our data deletion procedures. Certain data may continue to be retained for a limited period due to backup rotation, security, legal compliance, dispute handling, or other lawful reasons.

5.3 Encryption and Access Control

  • In transit: All communications are encrypted using TLS 1.2+, including API calls to LLM providers, message channel connections, and control panel access;
  • At rest: Stored with AES-256 encryption on GCP infrastructure;
  • Access control: Access to the relevant data and features is managed through Workspace permissions and role-based access control mechanisms, with identity verification performed via SSO or other applicable authentication methods.

5.4 Operational Security

  • Monitoring the operational status and security incidents of the OpenMax Services;
  • Implementing automated health checks and incident detection;
  • Managing relevant credentials through appropriate security mechanisms;
  • Conducting periodic security assessments of the platform infrastructure.

5.5 Data Breach Notification

  • In the event of a data breach affecting your personal information, we will promptly assess the impact of the incident and take reasonable remedial measures in accordance with the requirements of the regulatory authorities of the applicable jurisdiction and other applicable laws. Where required by applicable law, we will notify the Personal Data Protection Commission of Singapore, affected individuals, or other relevant parties within the statutory time limit. Where OpenMax processes the relevant personal data on behalf of a customer in accordance with the customer's instructions, we will notify the customer without undue delay after we have reasonable grounds to believe a data breach has occurred, and will provide such assistance as is reasonably necessary for the customer to fulfill its relevant assessment and notification obligations.
  • The foregoing notification does not constitute an admission by OpenMax of liability for the relevant incident, and any such liability shall be determined based on the cause of the incident, applicable law, and the agreement between the parties.

6. International Data Transfers

As of the last updated date of this Policy, OpenMax's infrastructure is hosted on Google Cloud Platform. Depending on the services you use, the relevant service providers, and the locations of their infrastructure, your personal information may be stored, transmitted, or processed in Singapore and other countries or regions, including cross-border transfers arising from the use of the service providers described in this Policy.

Where required by applicable law and reasonably practicable, we will indicate, in this Policy or through other appropriate means, the countries or regions in which the relevant overseas recipients may be located.

With respect to the foregoing cross-border transfers, we will, in accordance with the requirements of applicable data protection laws, adopt appropriate contractual, technical, or organizational measures (including, where applicable, entering into standard contractual clauses or adopting other recognized transfer mechanisms) to ensure that the relevant personal data receives the level of protection required by applicable law.

7. Your Privacy Rights

7.1 All Users

Subject to applicable law and platform functionality, you may:

  • Access the personal information we hold about you
  • Correct inaccurate or incomplete personal information
  • Delete your account and related personal information
  • Export the relevant conversation, memory, and configuration data, subject to platform functionality and your Workspace permissions
  • Manage or clear the relevant memory data, subject to platform functionality and your Workspace permissions
  • Unsubscribe from marketing communications and manage your marketing preferences

To exercise these rights, please contact us at privacy@openmax.com. We will process your request within the time period required by applicable law.

Where the purposes and means of processing the relevant personal information are determined by the organization or administrator of the Workspace, you may need to submit your request to the relevant organization or Workspace administrator; OpenMax will provide reasonable assistance in accordance with applicable law and the relevant data processing arrangements.

7.2 European Economic Area (GDPR), United Kingdom (UK GDPR), and Switzerland (FADP)

If the EU General Data Protection Regulation (GDPR), the UK General Data Protection Regulation (UK GDPR), or the Swiss Federal Act on Data Protection (FADP) applies to you, you may have the following rights:

  • Right to restriction of processing — Where provided by applicable law, request that we restrict the processing of your personal information
  • Right to object — Where provided by applicable law, object to processing based on legitimate interests or other specific grounds
  • Right to withdraw consent — For activities where processing is based on your consent, you may withdraw your consent at any time, without affecting the lawfulness of the relevant processing carried out prior to the withdrawal
  • Right to data portability — Where provided by applicable law, obtain the relevant personal information in a structured, commonly used, and machine-readable format, or request that the relevant information be transmitted to another party
  • Right to lodge a complaint — Lodge a complaint with a competent data protection supervisory authority

Legal Bases for Processing:

  • Performance of a contract: To provide the OpenMax Services to you, manage accounts and subscriptions, and perform the relevant contracts
  • Legitimate interests: To maintain platform security, prevent fraud and abuse, ensure the proper operation of the services, and improve the OpenMax Services and protect the legitimate rights and interests of OpenMax, users, and other relevant parties
  • Consent: Applicable to marketing communications, optional analytics, or other processing activities that require your consent
  • Legal obligation: To fulfill applicable tax, accounting, regulatory, and other legal obligations

We will process the relevant requests within the time period provided by applicable law. Where permitted by applicable law, the processing period may be extended depending on the complexity or number of requests, and we will provide you with notice where required by law.

7.3 California Residents (CCPA/CPRA)

If you are a California resident and the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), applies to you, you may have:

  • Right to know: Learn what personal information we collect, use, and share
  • Right to access: Request the personal information we are required by law to provide to you
  • Right to delete: Request the deletion of personal information within the scope provided by applicable law
  • Right to correct: Request the correction of inaccurate information
  • Right to limit: Where provided by applicable law, limit the use and disclosure of sensitive personal information
  • Right to non-discrimination: We will not discriminate against you for exercising your rights

We do not sell personal information. Where applicable law provides that our use or disclosure of personal information constitutes a "sharing" or cross-context behavioral advertising, you have the right to opt out of such processing, and we will provide the corresponding opt-out method in accordance with the law.

7.4 Singapore (PDPA)

If you are located in Singapore, you may have the following rights under the Singapore Personal Data Protection Act (PDPA):

  • Access the personal data we hold about you and information about how such personal data has been used or disclosed;
  • Correct inaccurate or incomplete personal data;
  • Withdraw the consent you previously gave for the collection, use, or disclosure of the relevant personal data, although withdrawal may affect our ability to continue providing certain services to you.

You may also export the relevant data through the features provided by the platform and your permissions within the Workspace.

7.5 Australia (Privacy Act)

If you are located in Australia, you may have the following rights under the Australian Privacy Act 1988 and the Australian Privacy Principles:

  • The right to access the personal information we hold about you;
  • The right to correct inaccurate or incomplete personal information;
  • The right to make a privacy complaint about the way we handle personal information.

If you believe that we have breached applicable Australian privacy laws, you may lodge a complaint with us at privacy@openmax.com. We will review the relevant complaint and respond to you within a reasonable period. If you are dissatisfied with our handling of the matter, you may, where applicable, lodge a complaint with the Office of the Australian Information Commissioner (OAIC).

7.6 Canada (PIPEDA)

If you are located in Canada, you may have the following rights under the Canadian Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy laws:

  • The right to access the personal information OpenMax holds about you
  • The right to challenge the accuracy and completeness of the information and request its correction
  • The right to withdraw consent, subject to applicable legal or contractual restrictions

8. Workspace Data

With respect to personal data that customers and their authorized Workspace members provide, upload, connect, or allow access to through the Workspace, and for which the customer determines the purposes and means of processing (hereinafter "Workspace Data"), OpenMax in principle processes the relevant Workspace Data in accordance with the customer's instructions and on the customer's behalf, in order to provide the OpenMax Services.

Workspace administrators may, in accordance with the features provided by the platform from time to time and the corresponding permissions, manage Workspace members and their access permissions, data retention settings, third-party integration authorizations, and AI Agents, memory, knowledge, files, and other Workspace Data.

Customers are responsible for ensuring that they have a legal basis, as required by applicable law, for the personal data they provide, upload, connect, or allow to be processed through the Workspace, and for providing the necessary privacy notices and obtaining the necessary authorizations or consents in accordance with applicable law.

With respect to personal information that OpenMax processes for its own purposes, such as account management, billing, security, service operations, and legal compliance, OpenMax will handle it in accordance with the other relevant provisions of this Privacy Policy.

9. Minors' Privacy

The OpenMax Services are not intended for registration or direct use by individuals under the age of 18, and we do not knowingly permit individuals under the age of 18 to register an OpenMax account in their own name.

Because OpenMax provides users with AI Agents and related data processing services, the content that users or enterprise customers provide, connect, or allow AI Agents to access in the course of using the services may contain the personal data of minors. In such cases, the relevant users or enterprise customers shall ensure that they have the legal basis, authorization, or consent required to collect, use, disclose, and instruct OpenMax to process the relevant personal data, and shall comply with applicable requirements for the protection of minors' personal data.

OpenMax will process such personal data to the extent necessary to provide the services, in accordance with the instructions of users or enterprise customers and applicable law, and will adopt protective measures commensurate with the nature of the data and the associated risks.

If we discover that an individual under the age of 18 has, without authorization, registered directly or provided their personal data to OpenMax, we may take measures such as restricting or closing the relevant account, deleting the relevant information, or other appropriate measures required by applicable law. If you believe that any of the foregoing has occurred, please contact us at privacy@openmax.com.


10. Third-Party Links and Integrations

You may connect to, access, or use AI Agents, models, applications, tools, communication channels, or other products and services provided by third parties through the Workspace. Such third-party products or services are provided and controlled independently by the relevant third parties, and their collection, use, disclosure, and other processing of personal information are governed by their own privacy policies, terms of service, and other applicable rules.

When you connect or authorize third-party products or services through the Workspace, OpenMax may, based on your configuration, authorization, and the requirements of providing the relevant features, transmit information to the relevant third parties or access information provided by the relevant third parties. You should reasonably configure and manage the relevant access permissions according to your actual needs, and you may withdraw or adjust authorizations (where applicable) through the OpenMax Services or the methods provided by the relevant third parties.

OpenMax is not responsible for the privacy or data processing practices of third-party products or services themselves. We recommend that you review the privacy policies and related terms of the relevant third-party products or services before connecting to or using them.


11. Changes to This Policy

We may update this Privacy Policy from time to time.
